RECREATION GROUPS TO FILE LAWSUIT AGAINST FOREST SERVICE TO RESTORE ACCESS

On December 18, 2007, the agency issued a closure order which UFWDA, BRC, and Southern contend is based on outdated and incomplete science. The law suit will seek to declare unlawful and set aside the closure order.

"Our organizations value their relationship with the Forest Service, however management by closure does not address the issues we need to be surmounting through collaborative and creative efforts," observed Jay Bird, of Southern Four Wheel Drive Associations. "There is no defensible scientific correlation between OHV use and water quality, erosion, and sedimentation issues in this area, and our organizations have long demonstrated their dedication to the environment and support of trout populations in the area through user education, route maintenance and improvement. Active and effective management of motorized recreation, not prohibition, is the only good answer for protecting water quality and species habitat at the Upper Tellico OHV area," Bird concluded.

Further information about the plaintiff organizations, including information about developments in this action and others, can be found as indicated below.

Reward offered for vandalism tip

According to the National Park Service investigation, two sets of footprints were found along the edge of the fence line that extended from the dunes to the waters edge. No footprints or tire tracks were observed entering the closed area which was established to protect a least tern colony; no birds appeared to have been disturbed during the act of vandalism.

A recent court approved Consent Degree requires the National Park Service to automatically expand the closure area by 50 meters where a confirmed deliberate act disturbs or harasses wildlife or vandalizes fencing, nests, or plants. The vandal(s) action leading to the subsequent enclosure enlargement have not caused harm to the birds but have caused additional harm to the businesses and ORV community recreating and fishing at Cape Hatteras!

10 Safety Rules For Off-Road Driving

1. Let someone know where you will be and when you expect to return. This applies to all trips, not just those in challenging areas. People have been known to get stuck or lost in relatively easy terrain. Should something happen and you’re unable to leave the area or call for help, your friends or family will know to contact authorities.

2. Always have at least one other vehicle along. This ensures that you will have transportation out in the event your vehicle becomes stuck or damaged and can’t be fixed there. Plus, the extra vehicle means additional manpower to help with problems.

Open House and Public Meeting Planned for Clear Creek Asbestos Health Risk Presentation

News Release

Open House and Public Meeting Planned for Clear Creek Asbestos Health Risk Presentation

The U.S. Bureau of Land Management (BLM) will host an open house and a public meeting May 8 in Santa Clara for the Environmental Protection Agency (EPA) to present its human health risk assessment for asbestos exposure from recreational use of BLM’s Clear Creek Management Area (CCMA). BLM will also present information on its recent closure of about half the area in response to the findings.

EPA's assessment, released May 1, states that asbestos exposures measured by EPA for many recreational activities at CCMA are "above the EPA acceptable risk range of lifetime cancers," and also concludes that children "have greater risk than adults due to higher exposure measurements [and] are of special concern because their exposures occur earlier in their lives."

BLM issued an immediate temporary closure of 31,000 acres of the 63,000 acres of public lands in the CCMA, located in western Fresno and eastern San Benito counties, in response to the assessment, according to BLM Hollister Field Manager Rick Cooper. The EPA assessment is available online at www.epa.gov/region09/toxic/noa/clearcreek; the BLM closure order is at www.blm.gov/ca/hollister.
